Terms of Service

Quotation
Quotations are only valid for 30 days from date of issue. Specifications are subject to change if we do not receive confirmation of acceptance within this period. All errors are subject to correction.
The current service fees are below:
- $80 per hour (+ GST) for all Web, Flash and Photography work.
- $70 per hour (+ GST) for all Graphic Design and Print work.
Any work which extends outside the limits of the quotation is charged half the hourly fee per half hour plus GST. BENB reserves the right to change its fees at any time without notice.
Website Designer Branding
All websites administered by BENB from design to development will have a link to www.benb.com.au at the bottom of each page. The link may be in the form of a small graphic or text.
Copyright
Artworks remain copyright to and the property of BENB until all outstanding invoices are paid in full. Any non-final artwork such as drafts remain copyright to and the property of BENB.
BENB reserves the right to use all artworks administered by the business for display in portfolios, online or on print for business showcase and advertising purposes.
Due to international copyright and trademark law, BENB will not be held liable should the client be found to be infringing on an already existing copyright, trademark or service mark relative to the project name, description or service.
Limitation to Copyright
Websites or other online materials administered by BENB including custom code relative to page design, layout and functionality are licensed to the client only for use as installed by BENB. Application of the codes outside of BENB on non-related projects is prohibited.
Cancellations
Cancellations of services are subject to a kill fee of 30% based on the agreed quotation plus all relative work administered thereafter. If at anytime the client decides not to progress further, then they shall be liable to pay the kill fee within 30 days of cancellation. In an event of a cancellation, all work administered up to the point of cancellation remains copyright to and the property of BENB.
Artwork Drafts
All drafts are subject to client's approval. Client is required to check all artwork drafts thoroughly to ensure everything is in order and without errors before publication. Client is required to notify BENB of all errors prior to approval. BENB will not be held liable should the artwork appear incorrect on publication.
End of Project
A project shall be deemed complete after the client has reviewed the product and indicated satisfaction in writing. If the client fails to contact BENB within a period of 30 days without explanation, the project shall be deemed satisfactory and complete.
Payments
Payment can be made via electronic transfer, bank deposit, cash or cheque. Please contact BENB for payment information.
Invoices are issued shortly after the project has been deemed complete. Standard payment request time is 30 days from date of invoice. Late payments are subject to a 5% increase per week based on the agreed quotation.
Suspension of Services
BENB reserves the right to suspend or cancel services in any event where the client fails to perform their obligations under the Terms of Service.
